I went to a free kickboxing class and 9 months later recieved a bill for not paying a membership. Need advice!?

Ijust received a bill in the mail from ASF international for non payments of monthly dues for la boxing. I am not a member ! I went into the Marietta Location early last year, In April sometime and attended a (one class ) free class to see if I was interested in joining the gym. Before I started I had to fill out a waiver with all my info (name, birthday, age and emergency contacts etc.) in case of an emergency during my workout. I remember joking with the man that took my emergency contact info about if I fell during my working that I couldn't’t sue. After my class was over I went to the front counter and asked what the fees wore if I wanted to join, he filled out a long piece of paper and then told me what my options wore and what it would cost me to join. I explained to the man behind the counter that the fees wore to high and I would’t be able to afford it for a while. I did not sign anything except for the waiver at the beginning of the class. Then I left. yesterday I received and bill in the mail for not paying dues????? I’m extremely upset with this in regards to the fact that I have never signed a contract nor have I ever paid a dime to this gym! I have never even received a phone call or a previous bill or statement that stated that I owed anything. Now, after almost 1 full year I receive a bill in the mail and states close to $300.00! I don’t understand how this is! Is is legal? They don't have my SSN! THANK GOD! can they send me to collections where it can hurt my credit with my ssn? Since the form says that I had to pay a down payment (never paid a dime) and i didn't and the contract wasn't even sent to the billing dept for 9 months after everything is dated and i never attended a class is there a way to fight this? I feel like I'm being scammed! I signed one place on the form under "waiver and release of liability" and the other signatures wore not from me! They look like my signatures and say its from me but i know for a fact that i didn't not sign anywhere Else! What do i do? do i have any options?

  1. I really don't know but I am almost positive that there is nothing they can truly do....I agree with you that is BS. I just wanted to answer this to tell you that you might get better results if you put this question in the legal section. Go to Politics and Government....Law and Ethics Section. Does this bill specify that you send payment in reference to a specific individual? If so, it may be some idiot employee trying to make some money...just a thought.
  2. I would get a lawyer and make them show you a copy of this supposed contract you signed. If it was just a wavier then you should be suing them because that nonpayment will be on your credit report and that will have to be fixed!
  3. Hi Emilee D. At this point if you are positive that you didn't give them your SSN or any credit card or payment information all they have is your name and address. So they can send you a bill but it is likely that it will not be on your credit report or anything. of that nature. However just to be sure you should go to a credit reporting agency to inquire about it. If for some unknown reason they do have that info you will need to hire a lawyer and likely launch an investigation as to how they got it. Also, read ALL of the fine print on the "bill" to make sure that it is actually that and not a scare tactic for them to try to scam your money. Compare it to one of your other monthly bills or final notice bills (if you have any). Also if you haven't already call the gym and ask them to clarify. Maybe it was just an honest mistake on their part. Try to figure out the exact day that free class was an Lastly keep a copy of your posting of this question and the date just for records. It could come in handy later, good luck I hope it turns out to be all a big mistake. :)
