I have received a court notice for speeding I have a foreign licence, can you advice me please?

I am a foreigner and have recently started living in the country as a permanent resident. I hold a foreign drivng licence which allows me to drive in the UK for 12 months from the date of my arrival. I received a ‘Notice of Intended Prosecution’ for driving 41mph within a 30mph zone and was asked to fill the form with named driver. I complying with the rules gave my name as the driver of the vehicle. I then received a ‘Conditional Offer of Fixed Penalty’ to either pay the fixed penalty or contest this in the court. I opted for a fixed penalty and filled the direct debit payment form and sent it to the Police along with my driving licence. My licence was returned along with the direct debit form informing me that this matter cannot proceed by way of fixed penalty as my licence was not issued by DVLA in Swansea, only licences issued by that authority can be dealt with in this manner and now the matter will proceed by way of a Court Hearing. I would be extremely grateful if someone could please help me by giving me some advice as to what will happen next and what should I do meanwhile.

  1. From what i have heard you cannot receive points on a licence which is not issued by DVLA hence they are forced to take you to court. Although usually the court just orders the fine to be paid from court instead of on the direct debit form. Im sorry i dont know any more details but this is what happened to my friend who has a Turkish licence.

  3. you should wait until the court hearing. you will be fined and have to either pay by cash or cheque. When you apply for your british license, which i am presuming that is what you are going to do, once you pass your driving test and obtain your license, the points may well go on it straight away, making your insurance much more expensive. Learn by your mistakes. when in this country, abide by the law, whether it is the law of the road or otherwise.
  4. all you can do is wait for a date of the hearing.don't worry, speeding is no big deal whatever court you are in.
  5. You will receive a court date and will be given the opportunity to write a letter of compassion ( sob story ) which will then be given to the bench of magistrates. This will be taken into consideration when passing sentence usually a fine And or points. Really nothing to worry about if you have any further questions contact the listings officer at the court.   6. They may well take this to a hearing in court, where they will take all details of your licence and contact the country of issue. All EU states will soon be on a system to notify each other member states of offences so that points do get added/taken away in accordance to the laws of the country of issue. Fines will also soon be chased up in the same way
